Question:

There is a man named [……….] from [……….] who is [……….]. He claims it is ok for hanafis to pray behind salafis that do masah wiping over cotton socks in wudu and says only strict hanafis say that you can’t. He says it’s ok because there is a valid ikhtilaaf. Is this correct?
There is a video of him saying all this and I have included a link so you can watch it.
Answer:
In the Name of Allah, the Most Gracious, the most Merciful.
In principle, according to the Ḥanafī madhhab, if the imām does any such action which renders the ṣalāh invalid in the ʾiʿtiqād (view) of the Ḥanafī muqtadī (follower), and the muqtadī is aware of this, then the ṣalāh of the muqtadī will be invalid. Hence, if the imām has made masḥ on thin socks, then it will not be permissible for a Ḥanafī to perform ṣalāh behind him (if he is aware of this). If one has performed ṣalāh behind such an imām and later comes to know of the action of the imām, then he has to repeat his ṣalāh. [1]
It should be borne in mind that there is no valid difference of opinion in the Ḥanafi school of law in regard to wiping over thin socks for wuḍūʾ. The difference of opinion is with regard to wiping over socks made from thick material which fulfil the conditions of “khuffayn” (leather socks), as set out by the jurists of the Ḥanafī madhhab.
According to the Ḥanafī madhhab, the following conditions have to be met for masḥ to be valid on jawrabayn (socks)[2]:
1. They should be worn after washing the feet (even if it is before the completion of wuḍūʾ).
2. They should cover the ankles.
3. They should be durable enough that one is able to walk one farsakh (3.45 miles) in them outdoors (without any shoes or any other footwear on top of them), without them tearing.
4. Each sock must be free from tears that are equal to the size of three of the smallest toes.
5. The socks should be able to remain on the feet without being tied.
6. They should be waterproof.
7. According to Imām Abū Ḥanīfah, the socks must either be mujalladayn, i.e. they should have leather on the top and at the bottom, or they should at least be munaʿalayn, i.e. they should have leather at the bottom. However, according to his students, Imām Abū Yūsuf and Imām Muḥammad, it is permissible to make masḥ on thakhīnayn (thick) socks. This is the muftā bihi (authoritative) position of the Ḥanafī madhhab. It has been reported that Imām Abū Ḥanīfah later held this opinion.
What is Thakhīnayn?
It should be noted that thakhīnayn does not refer to the thin cotton or nylon socks that are commonly worn nowadays. The jurists have categorically ruled that it is not permissible to wipe over jawrabayn that are thin.
Thakhīnayn are those socks that are equivalent to khuffayn (leather socks), i.e. they fulfil the six conditions listed above. On the other hand, nylon and cotton socks commonly worn in our times fall under the category of jawrabayn that are too thin and do not fulfil the above conditions.
Imām al-Marghīnānī states in his magnum opus al-Hidāyah:
ولا يجوز المسح على الجوربين عند ابى حنيفة الا أن يكونا مجلدين أو منعلين، وقالا: يجوز إذا كانا ثخينين لا يشفان لما روي أن النبي عليه الصلاة والسلام مسح على جوربيه ولأنه يمكنه المشي فيه إذا كان ثخينا وهو أن يستمسك على الساق من غير أن يربط بشيء فأشبه الخف وله أنه ليس في معنى الخف لأنه لا يمكن مواظبة المشي فيه إلا إذا كان منعلا وهو محمل الحديث وعنه أنه رجع إلى قولهما وعليه الفتوى. Hence, it will not be permissible according to all three imāms of the Ḥanafī madhhab to make masḥ on normal cotton socks. Nowadays, there are socks easily available that are suitable to make masḥ on for wuḍūʾ even though they are not made from leather. This is because they fall under the category of thakhīnayn as they fulfil all the conditions mentioned above.

Hence, the relatively modern view that it is permitted to wipe over such socks is a shādhdh (aberrant) opinion, that cannot be acted upon.
Lastly, it is important to bear in mind that a Muftī in our era is not entitled to issue fatāwā based on his personal views and what he “feels” or “considers” to be the correct view. A Muftī’s duty is to issue a fatwā according to the dominant position of his madhhab.[3] ʿAllāmah Ibrāhīm Pīrīzādah, the Ḥanafī Muftī of Makkah writes:
ليس للمفتي في زماننا إلا نقل ما صح عن أهل مذهبه الذين يفتي بقولهم
المقلد الذي ليس من أهل الاجتهاد كحنفية زماننا
ʿAllāmah Qāsim ibn Quṭlūbughā, the student of ʿAllāmah al-Kamāl ibn al-Humām states:
سمعت من لفظ بعض القضاة: هل ثم حجر؟ قلت: نعم! اتباع الهوى حرام والمرجوح في مقابلة الراجح بمنزلة العدم
The field of iftāʾ is extremely sensitive. The pious predecessors were extremely cautious in issuing fatāwā so as to not lead the masses into ḥarām or doubtful actions. A Muftī is responsible for each fatwā in the court of Allah. The general masses should also be careful in who they consult for their dīnī matters. One should consult a taqwā-conscious, qualified, Muftī, who clearly stays within the confines of his chosen madhhab.[4]

والمقتدي إذا اعتقد الفساد في صلاة إمامه تفسد صلاته كما لو اشتبهت عليهم القبلة فتحرى الإمام إلى جهة والمقتدي إلى جهة أخرى لا يصح اقتداؤه به إذا كان عالما أن إمامه يصلي إلى غير جهته
ذكر عن أبي مطيع [الحكم بن عبد الله البلخي (١١٥ – ١٩٩ ه)] أنه قال: كنت أصلي خلف هشام بن عروة يوم الجمعة – وهو يرى الماء من الماء، لا يرى الاغتسال من الجماع إلا بالإنزال – فخشيت أن لا تجوز صلاتي خلفه إذا فعل ذلك ولم يغتسل، وكنت لا أقدر أن أسأله عن ذلك، فقلت له: يرحمك الله، ترى الغسل يوم الجمعة واجبا؟ قال: أما إنني ما تركت الغسل يوم الجمعة منذ كذا وكذا سنة، فذهب الشغل عن قلبي (النوازل)
قال نصير: سألت شدادا [ابن حكيم (في حدود ١٢٥ – ٢١٠ ه)] عن المقتدي يرى البول على ثوب الإمام أقل من قدر الدرهم، والمقتدي من رأيه أن لا تجوز الصلاة إذا كان البول قليلا أو كثيرا، ورأي الإمام أن الصلاة جاىزة، قال: على المقتدي أن يعيد الصلاة؛ قال: قلت له: فإن كان رأي المقتدي جواز الصلاة ورأي الإمام فساد الصلاة ولا يعلم به الإمام وعلم المقتدي؟ قال: لا يعيد الصلاة، وإنما أنظر إلى رأي المقتدي، قال نصير: وبه نأخذ. وروى إبراهيم بن يوسف عن أبي يوسف قال: لو أن رجلا أعمى صلى ركعة لغير القبلة فجاء رجل وسواه وأقامه إلى القبلة، واقتدى به، جاز للإمام ولا يجوز للمقتدي، قال الفقيه: هذا إذا كان الأعمى وقت الافتتاح لم يجد أحدا يسأله، فأما إذا كان بقربه من يسأله فلم يسأله وافتتح الصلاة لغير القبلة لم تجز صلات (النوازل)
الأصل في هذا أن المذهب الصحيح الذي عليه جمهور المشايخ سلفا وخلفا عندنا…هو أن العبرة في جواز الصلاة وعدمه رأي المقتدي في حق نفسه لا رأي إمامه…ولو علم منه ما يفسد الصلاة عنده لا عند الإمام لا يجوز له الاقتداء به لما قلنا أن العبرة لرأي المقتدي…وإن صلى معه يعيد، صرح به الصدر الشهيد، وهذا هو الأصل الذي لا محيص عنه للحنفي (غاية التحقيق للسندي)

وشرائط الخف الذي يجوز المسح عليه أن يكون ساترا للقدم مع الكعب احترازا عن المتخرق وأن يكون مشغولا بالرجل احترازا عن مقطوع الأصابع إذا لبسه وصار بعض الخف خاليا من مقدمه فمسح على الخالي لا يجوز وإن يمكن متابعة المشي فيه احتراز مما إذا جعل له خفا من حديد أو زجاج أو خشب وأن ينقطع به مسافة السفر احتراز عما إذا لف على رجليه خرقة لا يجوز المسح عليها كذا في الإيضاح. فإن كان رقيقاً: لا يجوز المسح عليه بلا خلاف، وإن كان ثخيناً مستمسكاً ويستر الكعب ستراً لا يراه الناظر كما هو جوارب أهل مرو، فعلى قول أبي حنيفة رحمه الله: لا يجوز المسح عليه، إلا إذا كان منعلاً أو مبطناً، وعلى قولهما: يجوز. (المحيط البرهاني في الفقه النعماني. ج ١ ص ١٧٠. دار الكتب العلمية)
